About Medical Marijuana in Illinois

Illinois is one of the 15 states that have currently legalized cannabis for both recreational and medical use. They became the 11th state to do so in January 2020. They were the first state to legalize recreational cannabis sales via the state legislature instead of a direct vote by the people. Vermont was the first state to legalize recreational cannabis use, but their legislature did not provide for actual sales of cannabis until after Illinois.

Illinois has been leading the way for cannabis as an opiate replacement as well, enacting a pilot program in 2018 designed to steer patients toward using cannabis rather than opiates to reduce overall opiate deaths in the state. The program was made permanent in 2019, along with many other improvements, including several additional qualifying conditions.

Medical cannabis is taxed at 1% in Illinois, as opposed to recreational taxes, which are based on the strength of the product:
* 10% for less than 35% THC
* 20% for infused products such as edibles
* 25% for products with more than 35% THC
When combined with the states 6.25% sales tax and local taxes that can be as high as 3.5%, retail taxes can be as high as 19.5% to 34.7%.

Registered cannabis patients are also allowed to grow up to 5 plants for their own personal use, so the state allows a lot of advantages for medical cannabis patients.

How to Register as a Medical Marijuana Patient in Illinois

Illinois’ medical cannabis patient program application takes place entirely online now. The state no longer accepts paper applications. You can find Illinois’ online Medical Cannabis Patient Application here.

You must first meet the qualifications to get a patient registry identification card. Patients must be state residents, have a qualifying condition (the full list is below in the faq), get a signed certification from the doctor, and be at least 18 years old.

Patients also can’t hold a school bus permit or CDL and can’t be active-duty corrections officers, law enforcement, or firefighter.

Once your doctor provides your Physician Written Certification Form, you’ll need to scan it, convert it to pdf and upload it with your application. If you get your certification from ZenLeaf.Co, they will deliver it in pdf format so you can skip this step.

Your evaluation must have taken place within the past 90 days, and normally it would be required to be in person, but this requirement has been waived due to COVID until further notice.

Once you’ve uploaded all of your information and chosen a 1, 2, or 3-year application, you’ll need to pay the fee. The fee depends on the length of the certification you choose:
1-year = $100
2-year = $200
3-year = $250

The state will issue you a temporary registration card that you can use until your permanent card arrives in the mail. They issue the card fairly quickly too. Patients who finish their applications before 6 PM can print them out by 8:30 AM the following morning. The state recommends that you call the dispensary and check to be sure your card is active before driving there the first time.

For those who have trouble filling out their online application, the state offers free help through its county health departments. There is no charge for receiving this assistance.

How to Register as an MMJ Caregiver in Illinois

Some patients choose to have a designated caregiver who can purchase cannabis on their behalf. They’re also allowed to transport it and prepare it for patient use. Caregivers should never transport cannabis in the passenger seat of their vehicle. It should be carried in the trunk or a locked container.

To qualify as a person’s designated caregiver, you must:
* Be an Illinois state resident,
* Be taking care of only one qualified patient, and
* Be 21 years or older.

Caregivers must pay a registration fee unless the person they’re caring for has a terminal illness and has been diagnosed with six months or less to live.

Caregivers cannot :
* Use the patient’s cannabis,
* Grow, possess or distribute marijuana, or
* Purchase more than the maximum amount allowed for the patient in two weeks.

How to Renew Your MMJ Certification in Illinois
When you need to recertify will depend on whether you chose the 1, 2, or 3-year option for your certification. Illinois offers two types of renewal options:
1) An extension: Patients who don’t choose the 3-year option for their card can extend their certification without getting a new evaluation. The extension fee is $50 for a one-year renewal.
2) A full recertification: This option is for those who have already had their old card for three years with renewals or whose card has expired. This requires a new medical evaluation.

You’ll get a courtesy renewal reminder from the state 45 days before your card expires and a reminder for recertification for full renewals five months before your expiration date.

All renewals and recertifications are completed online.

Patient Possession/Purchase/Cultivation Limits
Adult residents in Illinois can purchase up to:
* 30 grams of flower
* No more than 500 mg worth of THC in infused products, or
* Up to 5 grams of concentrates.

Visitors from out-of-state have different purchase limits:
* 15 grams of flower
* Nor more than 250 mg worth of THC in infused products, or
* 2.5 grams of concentrates.

Medical patients can purchase 2.5 times more cannabis products than recreational patients. They may also cultivate up to 5 plants. Adult users cannot grow their own cannabis at all.

How to be a medical cannabis caregiver in ME

Maine has a fairly unique caregiver program, with two different kinds of caregivers. Each fills a very different need, but both are valuable to patients.

First, when a patient registers for Maine’s medical cannabis program, they can designate an immediate family member or member of their household as a caregiver. Those caregivers can:

  • Transfer up to 2.5 ounces of cannabis to the patient in their care
  • Cultivate cannabis for 2 family members or 2 members of their household
  • Cultivate up to 6 mature and 12 immature plants for each patient
  • Possess up to 8 pounds of harvested cannabis

Maine also allows caregivers to operate as a business, cultivating cannabis and providing care for multiple patients. These caregivers do not need to be related to or live with the patients they care for, and they do need to register with the state. Caregivers following this path must register with the state as a caregiving business. Caregiving businesses register and pay a fee based on the number of plants they cultivate. Their status affords them the ability to care for as many patients as they can with their allotment of plants, hire employees, and charge patients for their cannabis. They can also sell extra cannabis to licensed wholesalers.

The fee for business caregiver registration is up to $240 for each set of 6 plants cultivated, up to $1,200 for 30 plants, or $1,500 for a 500 sq ft plant canopy. There is also a $31 criminal background check fee.

All caregivers in Maine must be over 21, a resident of Maine, and must not have been convicted of a disqualifying offense.

How to be a medical cannabis caregiver in NJ

Like most states, New Jersey allows adult cannabis patients to designate caregivers to assist them in obtaining and administering their medicine. Minor patients are required to designate a caregiver. Usually, this is a parent or guardian registered along with the patient. In cases where the patient cannot make it to an alternative treatment center (ATC), they may designate two caregivers.

About Medical Marijuana in New York

Governor Cuomo signed New York’s Compassionate Care Act (S7923) in July 2014. This program authorizes registered patients in the state to purchase and possess marijuana provided by registered dispensaries. Unlike California, to participate in New York’s medical marijuana program, patients must register with the state and be approved first.

Medical practitioners who want to recommend cannabis in New York must complete a four-hour course and register with the OMC before certifying patients for medical marijuana treatment.

UPDATE: Any medical practitioner certified by New York state to prescribe controlled substances to humans (as opposed to veterinarians) can now complete the training and register with the state to recommend cannabis treatment. This includes nurse practitioners, dentists, physician assistants, midwives, and podiatrists, so long as they are registered to prescribe other controlled substances.

EXPANDED MEDICAL CONDITIONS: New York now allows practitioners to certify patients for medical cannabis treatment at their discretion. There is no longer a requirement to have a specific qualifying medical condition to join New York’s medical marijuana program.

Doctors are no longer required to prescribe exact dosages and brands. This can be left to the discretion of the pharmacist now. New York dispensaries still have a very pharmaceutical feel despite the addition of flower and loosened purchasing restrictions.

To reduce unnecessary trips to the dispensary, New York has updated their regulations to allow patients to purchase a 60-day supply of cannabis rather than the previously-allowed 30-day supply.

HOME CULTIVATION UPDATE: The comment period for home cultivation regulations is now complete. The OCM will be finalizing the regulations during the first quarter of 2022 or early in the second quarter, barring any unforeseen interruptions in the approval process.

ADULT-USE SALES UPDATE: Adult-use cannabis, although legalized for use by voters, isn’t available for purchase yet. The OCM anticipates that adult-use sales will begin in the last quarter of 2022 or early in 2023.

The sale of flower for vaporization is now allowed at medical marijuana dispensaries as of Oct. 2021, and the $50 state application fee has been permanently waived.

New York medical marijuana patients may be tempted to let their MMJ card lapse now that cannabis is legal, but this isn’t recommended. The state won’t have recreational cannabis sales until at least 2023, so you won’t be able to purchase your medical cannabis without your med card.

Becoming a medical cannabis patient in New York has never been easier. There are just a few simple steps. How to Register as a Caregiver in New York

In New York, any certified MMJ patient can designate up to five caregivers to help them purchase and administer medical marijuana. A person can be designated as a caregiver if they are 21 or older, are a resident of New York, and are not the medical practitioner that certified the patient.

A caregiver can register with New York once the state approves the patient’s application. A caregiver cannot assume their duties until they receive their approval and Registry ID card from the state.

How to Renew Your Registry ID

You must be re-certified by a medical practitioner before you can renew your registration. Any qualified, New York-licensed physician can provide this re-certification. Please note that you can’t purchase medical marijuana with an expired Registry ID, so you should plan to see a doctor for recertification before your current Registry ID is set to expire.

Your certification will usually last for one year, but doctors can set a shorter timeline if they feel that a one-year certification is not warranted. If you have a caregiver, they may not recertify until you first recertifICATION and receive Department approval.

The good news is that the OCM has made the re-certification process even easier. You no longer have to re-register with the state when renewing your certification. Your doctor will update your information in the system, and you can continue using your same card.

You can now re-certify before the 30-day period leading up to your expiration date. This will ensure MMJ patients don’t lose coverage if they have busy schedules and cannot recertify in that specific time window.

Re-certification must be completed before the current registration period expires, or you will need to re-register with the program.

Patient Possession/Purchase/Cultivation Limits

Patients aren’t allowed to cultivate cannabis in New York yet. The regulations to do so should be available within the late first quarter or early second quarter of 2022. Only registered organizations can grow, process, and sell cannabis and cannabis products.

Your purchase/possession limits are entirely up to your physician. In this sense, New York is very different from other states. Doctors provide precise brand, administration methods, and product requirements on recommendations, much like one sees with a prescription at a pharmacy. As part of the planned expansion of New York’s medical marijuana program, patients may purchase up to a 60-day supply from their dispensary instead of just one month.

Some patients need to have – or are required to have – a designated caregiver who can purchase cannabis on their behalf. They’re also allowed to transport it and prepare it for patient use.

In Ohio, your physician must authorize the use of a caregiver and link the caregiver to you in the state’s database if you need one. Your doctor is the only person who can complete this step. Once the physician enters the caregiver into the database, they will receive an email to complete the registration process.

A patient can link up to two caregivers to their account, and no caregiver can serve more than two patients.

Texas’ medical marijuana program has an unusual setup. Rather than recommending medical cannabis, Texas doctors prescribe it. But the types of cannabis products available are very limited. No smokable or vaporized forms are allowed.

The rules simply prohibit smoking or vaping, but due to the limited nature of the program, you won’t typically find topicals, transdermal patches, suppositories, or other forms that are found in states with more advance programs even though they’re technically allowed.

The state’s three licensed dispensaries typically have one or two chocolates, a couple selections of infused drinks, gummies with varying levels of THC and CBD, oils and tinctures.

Contrary to popular belief, THC-only cannabis with no CBD is available in Texas. Texas’s law limits the amount of THC in cannabis products by weight rather than in comparison to the CBD content. These THC-only products are designated by their 0:1 ratio.

At dispensaries, you’ll commonly find ratios of:

  • 0:1, consisting of THC with no CBD, and typically containing 10 to 20 mg per dose,
  • 1:1, which contain the same amount of CBD and THC and is mildly psychoactive,
  • 2:1, which contain twice as much CBD as THC and is considered very mildly psychoactive,
  • 20:1, which contain mostly CBD and are considered non-psychoactive
  • And occasional ratios in between.

Virginia doesn’t have a set list of qualifying conditions. Instead, the decision is up to the doctor. Currently, the law allows practitioners to issue written certifications for cannabis to “alleviate the symptoms of any diagnosed condition or disease determined by the practitioner to benefit from such use.”

To qualify as your caregiver, they must:

  • for patients under 18 years of age, be a parent or guardian unless it can be demonstrated that “no parent or legal guardian is appropriate or available.”

  • use the patient’s cannabis,
  • be the patient’s doctor,
  • purchase more than the maximum amount allowed for the patient.

The caregiver application fee is $50. The fee may be waived if the caregiver can demonstrate financial hardship.
